CASE STUDY 01 — CIPAA ADJUDICATION
Retention Payment Recovery — Commercial Development, Selangor
Challenge
A specialist subcontractor had completed works and was owed the final retention release of approximately RM 180,000. The main contractor raised vague defect allegations without substantiation and withheld payment beyond the contractual release date.
Approach
Kukuh Legal filed a CIPAA payment claim with a chronological bundle of certification documents, completion notices, and written records of unsubstantiated defect allegations. A detailed written submission addressed each counterclaim raised in the response.
Outcome
The adjudicator found in the subcontractor's favour. The retention sum was ordered to be released within the statutory period. The matter concluded within the standard CIPAA timeline with no further proceedings required.
CASE STUDY 02 — CONSTRUCTION ARBITRATION
Delay and Disruption Claim — Infrastructure Project, Johor
Challenge
A main contractor had been assessed substantial liquidated damages by the employer for a project that ran 7 months over the contractual completion date. The contractor contended that the delay arose from employer-instructed changes and late information releases.
Approach
Kukuh Legal developed a detailed delay analysis with the assistance of a programme expert, correlating employer instruction dates with project records. Written submissions addressed concurrent delay arguments raised by the employer's counsel.
Outcome
The arbitral tribunal granted a partial extension of time and reduced the liquidated damages assessed. The financial settlement reached reflected the delay entitlement established through the programme analysis conducted for the proceedings.

FIDIC Silver Book Review — Energy Sector Contract, Kuala Lumpur
Challenge
A Malaysian contractor was entering a significant EPC contract under FIDIC Silver Book conditions for the first time. The client was unfamiliar with the risk allocation that FIDIC Silver imposes on the contractor, particularly the employer's relief from design and specification risk.
Approach
Kukuh Legal prepared a focused review of the highest-risk clauses under Silver Book conditions and drafted a risk-allocation summary specific to the project's scope. Negotiation points were prioritised by financial exposure and likelihood of acceptance.
Outcome
The client proceeded to contract execution with a clear understanding of their risk exposure. Several recommended amendments were accepted in negotiations, including a modification to the dispute resolution clause favouring AIAC over foreign-seat arbitration.
