Where Kukuh Legal Began
Kukuh Legal was established in Kuala Lumpur with a single purpose: to provide straightforward, technically grounded legal counsel to parties caught in the difficult middle ground of construction disputes. The name Kukuh — meaning solid or robust in Malay — reflects the character of the work we do and the standard we hold ourselves to.
The construction industry in Malaysia carries its own legal landscape. PAM 2018, the CIDB standard form, FIDIC contracts, and CIPAA 2012 each create a specific environment for disputes to develop. Our practice was built from the ground up to work within that landscape — not as a secondary matter, but as the core of what we do.
We advise employers and contractors at the contract stage, when the language of variation clauses and payment mechanisms can still be shaped. And we represent clients in adjudication and arbitration when disputes cannot be resolved through discussion alone. Throughout, the aim is measured advice — not litigation for its own sake.

Specialises in PAM and FIDIC contract review, with a focus on risk allocation and variation clause structuring. Advises both employers and main contractors at pre-tender and post-award stages.

Construction Law in Malaysia: A Practice Built on Specificity
The legal framework governing construction and engineering contracts in Malaysia draws on several distinct instruments. PAM 2018 remains the dominant standard form for private building contracts. The CIDB standard form covers public sector projects. FIDIC conditions — particularly the MDB Harmonised Edition — are used across infrastructure and civil engineering. Each carries its own risk allocation logic, variation mechanism, and payment certification process.
CIPAA 2012 introduced statutory adjudication as a mandatory dispute resolution pathway for construction payment claims. Its application is broad, extending to most construction contracts in Malaysia. The Act requires strict compliance with service timelines, claim formats, and response procedures. A poorly prepared claim or response can determine the outcome before the substance of the dispute is even addressed.
For more complex matters — defects liability disputes, delay and extension-of-time analyses, termination-related claims — AIAC arbitration provides a structured forum with experienced arbitrators drawn from technical and legal backgrounds. The process is confidential and the award is binding. Preparatory work, including witness statements and expert evidence, requires careful coordination across potentially long timelines.
