1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

  • "Firm" / "We" / "Us" — Kukuh Legal, a legal practice registered in Malaysia.
  • "Service" — legal services provided by the Firm, including contract advisory, CIPAA adjudication representation, and construction arbitration representation.
  • "User" / "You" — any person accessing this website or engaging the Firm's services.
  • "Engagement Letter" — the written agreement between the Firm and a client setting out the scope, fees, and terms of a specific matter.
  • "Content" — all text, documents, and materials published on this website.
  • "Agreement" — these Terms and Conditions, together with any applicable Engagement Letter.

2. Acceptance of Terms

By accessing this website or submitting an enquiry, you accept these Terms and Conditions in full. If you do not agree, you must not use this website or engage our services.

Legal services are provided only to individuals and entities who are 18 years of age or older and who have the legal capacity to enter a binding agreement. Use of this website constitutes confirmation that you meet these requirements.

3. Website Use

This website is provided for informational purposes only. Content published on this website does not constitute legal advice and does not create a solicitor-client relationship. You should not rely on any content as a substitute for obtaining formal legal advice specific to your circumstances.

4. Legal Services and Engagement

A solicitor-client relationship is established only upon the execution of a written Engagement Letter signed by both parties. Submission of an enquiry form or telephone consultation does not constitute engagement of our services or create any legal obligation on the Firm to act.

Services are provided in accordance with the terms of the relevant Engagement Letter, professional obligations under the Legal Profession Act 1976, and applicable Malaysian Bar Council guidelines.

5. Fees and Payment

Fees for each service are discussed and agreed before work commences. Starting-point fees are published on this website for indicative purposes only. Final fees depend on the scope, complexity, and duration of each matter and are set out in the Engagement Letter.

Fees are quoted in Malaysian Ringgit (RM) inclusive of applicable taxes unless otherwise stated. Payment terms are specified in the Engagement Letter. Unpaid invoices may result in the Firm declining to continue the engagement.

Where a matter is concluded before completion or an engagement is terminated, fees will be assessed for work performed to the date of conclusion.

6. Intellectual Property

All content on this website — including text, structure, and design — is the intellectual property of Kukuh Legal. You may not reproduce, distribute, or publish any part of this website without prior written consent.

Legal advice, written submissions, and documents prepared by the Firm for a specific matter remain the intellectual property of the Firm, subject to any licence granted under the relevant Engagement Letter for the client's use in that matter.

7. Confidentiality

All information you provide to us in the context of an enquiry or engagement is treated as confidential under legal professional privilege, subject to mandatory disclosure obligations imposed by law or regulatory requirements. We do not disclose client information to third parties except as required to progress your matter or comply with applicable law.

8. Disclaimers

Content on this website is provided in good faith but without representation as to completeness or current accuracy. Legal frameworks change and the Firm does not accept responsibility for reliance on website content without obtaining current formal advice.

We do not make any representation as to the outcome of any legal proceedings, adjudication, or dispute resolution process. Past case outcomes described on this website are illustrative only and do not indicate what may occur in any future matter.

9. Limitation of Liability

To the extent permitted by Malaysian law, the Firm's liability in connection with website use is limited to losses directly caused by negligence and does not extend to indirect, consequential, or economic losses arising from reliance on website content.

Liability for services provided under an Engagement Letter is addressed in the terms of that agreement and governed by applicable professional indemnity obligations.

10. Indemnification

You agree to indemnify and hold Kukuh Legal harmless from any claims, losses, or expenses arising from your misuse of this website, breach of these Terms, or violation of applicable law.

11. Termination

Either party may terminate an engagement in accordance with the terms set out in the relevant Engagement Letter. The Firm reserves the right to discontinue website access for any user who breaches these Terms. Obligations that survive termination — including confidentiality, intellectual property, and payment obligations — remain in effect.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising from the use of this website or the services provided shall be subject to the jurisdiction of the courts of Malaysia, specifically those in Kuala Lumpur, Wilayah Persekutuan.

Where a dispute arises in relation to a matter under an Engagement Letter, the parties shall first attempt to resolve the matter through direct discussion before commencing any formal proceedings.

13. Changes to These Terms

We may update these Terms and Conditions from time to time. The revised version will be published on this page with an updated effective date. Continued use of this website following any revision constitutes acceptance of the updated Terms.
